We are Battolyser Systems (“Battolyser” or we/us/our), we are a purpose led technology company with only one goal: we want to realise Always Clean Energy. We are committed to respecting your privacy, protecting your personal data and handling information fairly, equally, responsibly and in accordance with applicable law. We define personal data broadly as information that directly identifies an individual or that makes an individual identifiable when combined with other information.
This Recruitment Privacy Statement (“Privacy Statement”) describes how we handle and protect your personal data in connection with our recruiting processes and programs.
This Privacy Statement only applies to the personal data of job applicants, potential candidates for employment or partnership and those who participate in our recruiting programs and events. This personal date is submitted directly to Battolyser through the online application process and follow-up conversations and/or through alternative channels (e.g. via professional recruitment agencies). Tis Privacy Statement does not apply to the personal data of our employees, partners, clients, vendors or any other person from whom we collect personal data for other purposes.
By submitting your personal data to us, you acknowledge that:
· You have read and understood this Privacy Statement and agree to the use of your personal data as set out herein.
· You are not required to provide any information to us, but your failure to do so may result in our not being able to continue your candidacy for the job for which you have applied.
· All of your presentations are true and correct to the best of our knowledge and belief, and you have not knowingly omitted any related information. Providing any inaccurate information may make you ineligible for employment.
· This Privacy Statement does not form part of any contract of employment offered to candidates hired by Battolyser.
We usually collect personal data directly from you when you apply for a role with us, such as your name, address, contact information, work and educational history, and achievements. If you receive an offer from us, we then conduct a background and reference check. We also collect similar data about you from third parties, such as professional recruiting firms, your references, prior employees, Battolyser employees with whom you have interviewed or who recommended your candidacy. We may also collect personal data from you online to the extent that you have chosen to make this information publicly available. For example, we may find your profile on professional social media websites, such as LinkedIn, and contact you about suitable roles.
Sensitive personal data is a subset of personal data that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, health, sexual orientation, trade union membership, biometric data, and other categories as prescribed by law. We do not collect or process any sensitive personal data about you unless it’s to operate our business, for legitimate employment-related purposes, or where otherwise permitted by, or necessary to comply with, applicable laws.
We may e.g. collect sensitive personal data about a candidate to support our efforts to create an inclusive and diverse work environment, or for the purpose of compliance with equal employment opportunity obligations or anti-discrimination laws. We may also collect sensitive personal data to the extent that a candidate chooses, without being asked, to voluntarily disclose it during the recruiting process.
We collect and use your personal data for legitimate human resources and business management reasons, including but not limited to:
· identifying and evaluating candidates for potential employment, as well as for future roles that may become available;
· maintaining records in relation to recruiting and hiring;
· ensuring compliance with legal requirements;
· fostering our diversity and inclusion programs and practices;
· conducting background and reference checks;
· protecting our legal rights.
If you accept a role at Battolyser, the information collected during the recruitment process may form part of your personnel file, to the fullest extend allowable, and will be processed in accordance with our Employment Privacy Statement.
We take care to only access or disclose personal data to those internally and externally who require access to perform their legitimate tasks and duties and in line with the purposes outlined above.
We will disclose your personal data to the following categories of recipients:
· Battolyser hiring team members in order to administer the recruitment processes, including managers, HR, administrators, other internal or external members of the hiring team;
· Third-party service providers that support our recruitment process, such as recruitment or executive search agencies involved in your recruitment or third-party survey tool providers designated by Battolyser;
· Third-parties where you have consented or otherwise instructed Battolyser to share your personal data.
Battolyser personnel authorized to access or discuss personal data must comply with confidentiality, privacy and security policy requirements. We will implement appropriate measures to provide assurance that third-party organizations that we use to process data on our behalf use information in a manner consistent with this Privacy Statement and with applicable law, and that the security and confidentiality of the information is maintained. We do not sell to third parties, or share with third parties for targeted advertising purposes, the personal data that we collect or process as part of our recruitment, employment or personnel management process or any related process. We do not keep personal data of candidates whose personal data is uninvitedly sent to us through third-parties and who have not explicitly consented or otherwise instructed us to keep and share their personal data.
Our legal basis or grounds for collecting and using your personal data as described in the Privacy Statement falls into the following categories under applicable law. The ground will depend on the information concerned and the specific context and purposes for which we collect it.
· Our legitimate business interests in administering an efficient recruitment process, evaluating applications, managing and accessing applicants effectively, and reconnecting talented individuals with future job openings.
· Performance of a contract: We process personal data to perform our obligations under an agreement we have with you or to take steps prior to entering an employment contract with you, where you are considered for employment. For example, we use your personal data to make you a job offer or complete a contract of employment with you.
· Other legal bases to comply with applicable laws.
· When you give us your consent to process your personal data. You can withdraw your consent at any time, which will not affect the lawfulness of the processing before your consent was withdrawn.
If you accept an offer of employment with us, any relevant personal data collected during your application and pre-employment period will become part of your personnel records and will be retained accordingly.
If we do not employ you, we may nevertheless continue to retain your personal data for a period of time for system administration purposes, to consider you for potential future job openings and to perform research. You can withdraw your consent at any time.
We may want to remain in contact with you and consider you for future employment opportunities. In such an event, we will seek your consent to include you in one of our talent pools or recruiting programs that provides both of us ways to stay in touch. Participation in these talent pools or recruiting programs is entirely optional. If you consent, we retain your personal data for a period of time specific to that program. You can withdraw your consent at any time.
We use generally accepted standards of technical and operational security to secure your personal data. Only authorized personnel of Battolyser and our third-party service providers are permitted to access personal data, and they are required to treat this information as confidential.
Please not that, despite these precautions, security of information transmitted through the internet can never be guaranteed.
We take reasonable steps that are designed to keep your personal data accurate, complete, and up-to-date for the purposes of which it is collected and used. In accordance with applicable law, you may have certain rights over the personal data we hold about you. These include the right to:
· Request information about the personal data we hold about you, including the details of how we use that information and who we share it with;
· Request a copy of the personal data that we hold about you;
· Amend or rectify your personal data if any of the information held about you is incorrect or out of date;
· Portability of your personal data;
· Request erasure of your personal data;
· Demand that we cease processing your personal data or that we restrict processing your personal data;
· Withdraw your consent to the processing of your personal data, to the extent our processing relies on your consent as the lawful basis for processing.

To help protect your privacy and security, we will take reasonable steps to verify your identity before granting you access to your personal data. We will make reasonable attempts to promptly investigate, comply with, or otherwise respond to your requests as may be required by applicable law. Depending upon the circumstances and the request, we may not be permitted to provide access to personal data or otherwise fully comply with your request; for example, where producing your information may reveal the identity of someone else.
Our application process allows you to provide us with relevant personal data from information you have on third-party websites, such as LinkedIn. If you choose to incorporate your personal data from third-party websites, it will be used in accordance with this Privacy Statement.
We may use cookies to identify you and your interests, to remember your preferences, and to track your use of our website. Some of our online recruiting activities are hosted by third-parties, such as LinkedIn. When you access sites operated by these third-parties, they may place their own cookies on your device. You will be asked for your consent in the cookies pop-up at our website.
We may update this Privacy Statement from time to time in response to changing legal, technical, or business developments. You can see when this Privacy Statement was last updated by checking the “effective from” date displayed at the top of this Privacy Statement.
